These terms and conditions of sale (referred to herein as 'Agreement') are applicable to any Order placed by You for Products as exhibited at the e-commerce Website store.eventhalia.com (referred to herein as the ‘Website’) and accepted by K&M Iniciatives Turístiques, S.L. (referred to herein as 'Eventhalia'). By confirming Your Order as per the Order Placement process, you are accepting the terms of this Agreement.
REGISTRATION AND AUTHORISATIONS
K&M Iniciatives Turístiques, S.L., does business as Eventhalia, which is a Registered Trade Mark in the Principality of Andorra. K&M Iniciatives Turístiques, S.L., is incorporated with the Ministry of Finances and Territory of the Principality of Andorra under the registration number 13477, Llibre S-189, Foli 371-380, and with the Trade and Industry Registry of Andorra under the number 922609H. SCOPE OF TERMS
Eventhalia, upon acceptance of an Order placed by You, will supply the products and services specified in the Order (the 'Product') to You, pursuant to the terms and conditions of this Agreement and its exhibits. Eventhalia’s acceptance of such order submitted by You is expressly limited to the terms and conditions of this Agreement. The details of the Product (e.g. travellers, quantity, price, and product specifications) shall be set forth in the relevant Order.
The Purchase of Products that Eventhalia advertises in its e-commerce Website at store.eventhalia.com is conducted by placing the Products in the Shopping Cart and by following the Checkout process, by providing Your Billing Details, providing a Payment Method, agreeing to the terms of this Agreement and by concluding the purchase by pressing on Confirm Order button. The prices are payable by You as per the terms of the Order for the Products to be supplied by Eventhalia under this Agreement. By pressing on Confirm Order, You are entering into an irrevocable commitment to purchase under this Terms.
The payment for the Products upon the confirmation of an Order can succeed in two ways: you can either provide your credit card details during the Checkout process or you can make a transfer to the bank account, details of which are provided during Checkout, within 24h of the Order placement.
The Website can display prices in various currencies, however the base currency are Euros and so the Product prices can see vary their price depending on the exchange rate of the market at each given time. Payments will be processed in Euros and you are requested to make transfer payments in Euros.
PAYMENTS WITH CREDIT CARD
By pressing on Confirm Order during the Checkout process, you are irrevocably authorizing Eventhalia to charge the provided credit card the amount stated in the Shopping Cart for the Products, which you are then ordering. You certify that you are the owner of the credit card and that you are authorized for its use within the limits provided to You by your bank.
PAYMENTS BY BANK TRANSFER
By pressing on Confirm Order during the Checkout process, you are irrevocably committing to the purchase of the Products placed in the Shopping Cart and are committing to the remittance of the funds in the specified timeframe. Electronic Transfer Payments should be made under SHARE cost basis. Eventhalia will not confirm your booking until funds have cleared in Eventhalia’s account and for that please allow at least 3 working days for international clearing of funds. You are encouraged to send to Eventhalia the transfer confirmation receipt together with your booking reference at firstname.lastname@example.org.
Eventhalia will confirm the Order within 24h once funds have been received and cleared in the account or the credit card payment has been processed. After the confirmation, you will receive an electronic invoice for the purchased Products with the Order and the corresponding vouchers and e-tickets.
All prices include the Andorran Sales Tax IGI (Impost General Indirecte) in accordance with the article 43.1.b of the IGI Law 11/2012 of the Principality of Andorra of 21 June 2012.
OUT OF STOCK
From the point of Order placement and the reception of the funds, or the successful credit card payment processing, the availability of the Products contained in the Order could be reduced or even restricted during some or all of the dates selected. In such case Eventhalia will contact You to inform about alternative options and otherwise you will be entitled to a full refund. All Products exhibited at the Website are subject to availability and this is not guaranteed until successful payment has been obtained from you.
Check with Eventhalia before placing Orders for Products consisting of more than 25 travellers as you could be entitled to possible group discounts and tailored transportation solutions (special pick up times and conditions).
ALTERNATIVE PRODUCT CONFIGURATIONS
Alternative travel dates, durations and departure airports are available on request. Also we can provide you with customized traveler configurations if you are looking at any special room arrangements or special discounts for accompanying partners who do not ski and do not require a ski pass.
As per the details in the Product description Eventhalia may provide a holiday representative, who will be on duty 24/7 to assist with any of your needs during your stay as per the purchased Product. The representative will provide support in the language of the purchased Product (English, Polish, German, or Spanish). If you require assistance in another language please consult with us prior to Order placement.
In those products which include a Welcome Meeting the holiday representative will provide so to all arriving guests at a set time after your arrival, typically during the following morning. You will be explained about the hotel amenities, the area and optional activities and excursions to make during your stay or will assist you with any special arrangements.
CANCELLATIONS / NAME CHANGES
Unless otherwise stated in the Product description, the following cancellation conditions apply. We strongly recommend that you book Cancellation Insurance together with your Order. Eventhalia offers comprehensive Cancellation Insurance and Travel Insurance under the Specials section in the Website, which you can book at the time of Order Placement by adding the insurance to your Shopping Cart or at a later date or on request.
Flights are non-refundable and changes not permitted. All other services included in your Product can be modified/cancelled as per the following fees calculated on the basis of the Product fare without flights:
16 days before start of journey or less, 15% cancellation fee applies.
12 days before start of journey or less, 25% cancellation fee applies.
5 days before start of journey or less, 50% cancellation fee applies.
2 days before start of journey or less, no refunds available.
Special conditions apply in high season, during the dates 25/Dec-11/Jan, as follows:
30 days before start of journey or less, 50% cancellation fee applies.
15 days before start of journey or less, no refunds available.
Name changes may be possible on request up until 5 days before start of journey or less, except for the flights, which do not accept name changes. Hotel changes may be possible on request and cancellation/re-booking fees can apply.
Complimentary tickets to Caldea are for a general admission, which is a 3h visit of the thermal center. At Caldea, Europe’s largest mountain spa resort, the thermal water flows at a temperature of 70ºC and possesses very special properties. This water is rich in sulphur, minerals and sodium and enriched by such ingredients as thermal plankton. Applied in a natural way, it has an antalgic, healing, decongestant and anti-allergic effect on your body. SWIMWEAR PROTOCOL: Ladies can access the premises wearing a swimsuit or a bikini while gentlemen may use swimming trunks or swim briefs. The use of beach or outdoor-type flip-flops is not allowed. You may walk barefoot or use the disposable latex slippers available from the Caldea Shop. The use of a swim cap is not compulsory. Should you wish to do so, towels and hooded bathrobes can be rented for a small fee upon arrival. ADMISSION: For safety reasons, children under 5 are not admitted. For children aged 5 to 16 a document with proof of age must be submitted and they must be accompanied by an adult (one adult for every three children). All people below the height of 1.30m must wear arm bands. For hygiene reasons, people with surface wounds or bandages or plaster casts on any part of their body will not be admitted. Check any other special rules and regulations which may apply upon arrival at the Caldea thermal center.
Flights are as per the details in the Product description. Return journey flights are typically midday or early afternoon flights with arrival during the same day at destination. The start of the return journey is typically at 8am from the hotel and times will be arranged with our local representative at destination. If you would like to stay one day longer at Barcelona before the return flight, please contact Eventhalia for options and fee conditions apply. Eventhalia is acting as a reseller for the flights in the Product and the Airline carrier’s specific terms and conditions apply in virtue of the agreement between You and the Airline as set forth in the conditions of the ticket fare. Please contact Eventhalia if you would like to request the terms and conditions of the Airline Carrier prior to Order placement.
Transfer from Barcelona El Prat Airport or Hotel in Barcelona to Andorra hotel and back at fixed times. Our local representative will collect you at the arrivals hall at the airport and will accompany you to the bus departing booth. Transfer vehicles are dependent on reservations on the date and time chosen and are operated on a share basis with other guests from Eventhalia. Please inform Eventhalia during the Order placement process, or afterwards as soon as possible, if you are carrying oversized or ski equipment. We will endeavour to reduce your waiting time at the airport to a minimum.
Complimentary gifts as per the details provided with the Product will be provided at destination at any point during your stay, although Eventhalia will endeavour to provide you with the complimentary gift on arrival at your hotel.
Unless otherwise stated the Products are provided with no insurance. We strongly recommend you to purchase appropriate travel and medical insurance cover prior to commencement of the trip. Travel insurance is available and can be purchased by adding it to the Shopping Cart and placing the corresponding Order as per the Order Placement process. Travel insurance is provided by ARAG a leading European Insurer with over 75 years of experience and provides a comprehensive travel insurance that includes medical cover and healthcare assistance to include casualty and specialist assistance, early return due to bereavement and repatriation in case of accident or death, convalescence at the hotel and compensation for theft and damage of your luggage and ski equipment up to a limit, unless otherwise stated in the Product details. Please read the comprehensive details of the covered risks as stated in the Product details before purchasing the Product.
Unless otherwise stated the Products are provided with no insurance. Cancellation insurance is available and can be purchased by adding it to the Shopping Cart and placing the corresponding Order as per the Order Placement process. Cancellation insurance is provided by ARAG a leading European Insurer with over 75 years of experience and provides cover in the event of early cancellation of your trip or purchased Product under certain conditions like a medical condition or accident.
BUSINESS INSURANCE / LIABILITY INSURANCE
Eventhalia benefits from liability insurance provided by FIATC Seguros with a maximum risk insured of up to €450,762.00 which includes liability and accidents. FIATC is now the second-largest mutual insurance company in Spain and the first in Catalonia in terms of the volume of premiums.
COMPANY DEFAULT / CERTIFICATE OF GUARANTEES
Eventhalia has deposited a Bank Guarantee with the bank Crèdit Andorrà of Andorra in the amount of €200,000.00, which matches and exceeds any mandatory requirements by the applicable Law.
COUNTRIES VISITED AND VISAS
It is Your responsibility to obtain the necessary entry visas to each country visited with the purchased Products – we can help you process your visa application if instructed. Additional fees apply.
LIMITATION OF LIABILITY
In no event shall Eventhalia be liable hereunder for incidental, special, indirect, consequential or punitive damages, and any liability incurred under the terms of this Agreement or applicable by Lay shall be limited to the total Order value hereunder for the invoice upon which a claim is based.
Eventhalia shall not be liable for any failure to perform or delay in performance of this Agreement to the extent that any such failure arises from acts of God, war, civil insurrection or disruption, riots, government act or regulation, strikes, lockouts, labor disruption, cyber or hostile network attacks, weather conditions or any cause beyond Eventhalia’s commercially reasonable control.
COMPLIANCE WITH LAW
Eventhalia shall comply with all Andorran laws and regulations applicable to its performance hereunder.
The Order and this Agreement shall be governed by the laws of the Principallity of Andorra.
In the event any provision of the Order under this Agreement is held by a tribunal of competent jurisdiction to be contrary to the law, the remaining provisions of the Order or this Agreement will remain in full force and effect.
